Weather Cancellation

ESL Padel accepts cancellations via phone or Playtomic App with 24hrs notice.

In case of Any cancellations for adverse weather, booking must be cancelled at least 24hrs in advance to receive a full refund or credit towards a future game.

Cancellations made within 24hrs of the scheduled game time will not be eligible for a refund or credit, except for weather disruptions:

If the weather at the time of your scheduled game is deemed to disrupt play (e.g. heavy rains, lightning, high winds) you may cancel your booking without penalty.

The decision to cancel due to weather conditions is at the discretion of ESL PADEL club management.

Players are encouraged to contact ESL PADEL if there are any concerns about the weather affecting their game.

ALL ESL PADEL PLAYERS, VISITORS, COMPANIONS AND PARTICIPANTS AGREE AND AKNOWLEDGE THE FOLLOWING:

In consideration of being allowed to participate in any way in ESL PADEL courts, programs, classes, related events and activities, including but not limited to Padel, the undersigned player acknowledges, appreciates, and agrees that:

1. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS
I acknowledge that participation in Padel, involves inherent risks, including but not limited to the following:

Muscle strains, joint injuries (especially knees and shoulders), slipping on court surfaces, falls, being struck by balls or racquets, fractions, concussions, dehydration and any other injuries related to intense physical activity or overuse injuries due to repetitive motion.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others and assume full responsibility for my participation and waive any right to sue ESL PADEL, to any claim or rights, reimbursement and/or seek for financial restitution or any remedy against ESL PADEL, its partners, shareholders and employees.

2. MEDICAL FITNESS AND INSURANCE
I certify that I am physically fit and have not been advised otherwise by a qualified medical person. I confirm that I have adequate health insurance to cover any injury or damage I may cause or suffer while participating. I acknowledge that ESL PADEL does not provide medical or accident insurance.

3. RELEASE OF LIABILITY
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE AND HOLD HARMLESS ESL PADEL, their officers, officials, agents, shareholders, affiliates and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

4. EQUIPMENT USAGE
I understand that to participate in PADEL I must use all equipment in accordance with the instructions provided. I agree to return all equipment in the condition it was received, minus normal wear and tear. I acknowledge that I am financially entirely responsible for any damage to the equipment caused by my misuse.

5. COMPLIANCE WITH RULES
I agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.

6. MEDIA RELEASE
I grant permission to ESL PADEL to take and use photographs, videos, or other images of me in connection with my participation in these activities for promotional purposes without expectation of compensation.

7. GOVERNING LAW
This Waiver and Release shall be governed by the laws of the state of California, USA, without regard to its conflict of law provisions.

8. SEVERABILITY
If any portion of this Waiver and Release is declared invalid or unenforceable by a final judgment of any court of competent jurisdiction, the remaining portions shall remain valid and enforceable.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
